Agreement

By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the site or place an order.

Products and descriptions

We describe the Apache as accurately as we can, including its measurements, materials and construction. Manufacturing tolerances mean that individual paddles vary slightly, particularly in weight, which we publish as a range of 7.8 to 8.1 oz. Photography and video are representative; color can vary between screens.

The Apache is approved by USA Pickleball. You can confirm its current status on the official USA Pickleball paddle list. Approval status is maintained by USA Pickleball, not by us.

Pricing and payment

Prices are shown in U.S. dollars and may change at any time before you place an order. Taxes, where applicable, are handled as required by law. Payment is processed by Stripe. Placing an order is an offer to buy; a contract is formed when we accept your order and ship it. We may decline or cancel an order, including where a product is unavailable or where a price or description was listed in error, and we will refund you in full if we do.

Warranty

The Apache carries a 1-year limited manufacturer warranty. Its full scope, exclusions and claim process are set out on the Warranty page and form part of these terms. Except for that limited warranty, and to the fullest extent permitted by law, products are provided without other warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Use of the website

You may use this site for lawful purposes only. You agree not to interfere with the site, attempt to gain unauthorized access to it, use it to distribute malware, scrape it in a way that burdens our systems, or use it in a way that infringes anyone's rights.

Intellectual property

The TRIBE name, the TRIBE logo and emblem, the Apache paddle design and artwork, and the text, photography, video and layout on this site are owned by Tawodi, Inc. or used with permission. You may not copy, reproduce or use them commercially without our written permission.

Assumption of risk

Pickleball is a physical sport. You are responsible for using the paddle safely and for playing within your ability. Do not use a paddle that is cracked or damaged.

Limitation of liability

To the fullest extent permitted by law, Tawodi, Inc. is not liable for indirect, incidental, special or consequential damages arising from your use of this site or of a product. To the fullest extent permitted by law, our total liability relating to a product is limited to the amount you paid for that product. Some jurisdictions do not allow these limitations, in which case they apply to you only as far as the law allows.

Third-party links

This site links to third-party sites, including USA Pickleball and our payment processor. We do not control those sites and are not responsible for their content or their practices.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. This does not remove any protection you have under the mandatory law of the place where you live.

Changes to these terms

We may update these terms. The version in force when you place an order is the version that applies to that order. Changes take effect when posted, and the date at the top of this page will be updated.
